Davis|Stibor obtained a favorable settlement from McCarran International Airport, Clark County Department of Aviation (“McCarran”) on behalf of its client, an asbestos removal subcontractor. In 2012, Davis|Stibor’s client entered into a contract to perform asbestos removal from an abandoned motel owned by McCarran for $360,000.00. Shortly after work started, Davis|Stibor’s client discovered substantially more asbestos than was identified in the bid documents. Further investigation revealed approximately three times more asbestos than was identified in the bid documents. This significant discovery tripled the price of the asbestos removal work. McCarran directed Davis|Stibor’s client to proceed with the additional work on a time and material basis. When the work was completed, McCarran refused to pay Davis|Stibor’s client over $150,00.00 worth of work it performed.
Davis|Stibor was retained and appealed McCarran’s refusal to pay. Under the contract, McCarran was required to review the denial and Davis|Stibor’s legal arguments. On appeal, McCarran affirmed its prior decision, and entered its final decision to not pay the $150,000.00. After Davis|Stibor made further legal arguments, and notified the Clark County Commission of the dispute, McCarran requested that the dispute be mediated. After four (4) hours of mediation, Davis|Stibor obtained a favorable, confidential settlement on behalf of its client, saving tens of thousands of dollars in legal fees that would have been spent in subsequent litigation.
