Shan Davis & Associates was retained to represent a consulting company who performed fiber optics installation work for a Department of Energy construction project connecting Creech Air Force Base and Nellis Air Force Base. The Department of Energy’s agent, and general contractor, was a large corporation that manages the National Security site located north of Las Vegas, with offices located in several U.S. states and two foreign countries. Shan Davis & Associates’ client, a small sub-subcontractor, was not paid for some of the work it performed. The general contractor blamed its failure to pay on its subcontractor alleging that the subcontractor failed to pay for, among other things, union dues and other sub-subcontractor claims. Although the general contractor had received payment from the Department of Energy, it claimed that it was not required to pay Shan Davis & Associates’ client because it did not have a contract with the client.
Shan Davis & Associates filed a complaint in Federal District Court for the District of Nevada alleging causes of action against the general contractor for breach of contract as a third-party beneficiary, unjust enrichment, negligence and equitable lien. After six months of litigation, Shan Davis & Associates obtained a favorable settlement on behalf of its client. The terms of the settlement are confidential.
